1. Agreement to Terms

Welcome to bygame, an online casino and sports betting platform operated under license from the Philippine Amusement and Gaming Corporation (PAGCOR) and authorized to provide remote gaming services to eligible players within the Philippines. By accessing, browsing, registering an account, or otherwise using the bygame website, mobile applications, or related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (the "Terms"), together with our Privacy Policy, Responsible Gaming Policy, and any other supplementary terms, rules, or guidelines posted on the Platform.

These Terms constitute a legally binding agreement between you (the "User," "Player," or "you") and bygame (the "Company," "we," "us," or "our"). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform and refrain from creating an account or placing any wagers. Your continued use of the Platform following any amendments to these Terms shall constitute your acceptance of such modifications.

1.1 Amendments and Modifications

bygame reserves the right to amend, modify, supplement, or replace these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the Platform with an updated "Last Updated" date. It is your responsibility to review these Terms periodically to remain informed of any modifications. Continued use of the Platform following such changes constitutes acceptance of the revised Terms. Material changes that affect your rights or obligations may be communicated via email or prominent notice on the Platform.

1.2 Supplementary Terms

Certain features, promotions, games, or services offered through the Platform may be subject to additional terms, rules, or conditions ("Supplementary Terms"). In the event of any conflict between these Terms and any Supplementary Terms, the Supplementary Terms shall prevail with respect to that specific feature, promotion, game, or service. All Supplementary Terms are incorporated by reference into these Terms and form part of the agreement between you and bygame.

2. Eligibility and Account Registration

2.1 Age and Jurisdictional Requirements

To register an account and use the bygame Platform, you must meet all of the following eligibility criteria:

• You must be at least twenty-one (21) years of age or older, in accordance with Philippine gaming regulations and PAGCOR licensing requirements.
• You must be physically located within the territory of the Republic of the Philippines at the time of account registration and whenever accessing or using the Platform.
• You must be legally capable of entering into binding contracts under applicable Philippine law.
• You must not be legally prohibited from gambling or using online gaming services under any applicable law, regulation, or court order.
• You must not have previously been excluded or banned from the Platform or had an account closed by bygame for breach of these Terms.

bygame employs age verification systems and may require submission of valid government-issued identification documents (such as a Philippine passport, driver's license, or UMID card) to verify your age and identity. By creating an account, you consent to such verification procedures and acknowledge that your account may be suspended or closed if you fail to provide requested verification documents within a reasonable timeframe.

2.2 Account Registration and Security

When registering for a bygame account, you must provide accurate, complete, and current information as prompted by the registration form. You agree to maintain and promptly update your account information to ensure its accuracy and completeness. Providing false, misleading, or fraudulent information constitutes a material breach of these Terms and may result in immediate account suspension or termination.

Each individual person may maintain only one (1) account with bygame. Creating multiple accounts, using false identities, or attempting to circumvent account restrictions is strictly prohibited and will result in closure of all associated accounts and forfeiture of any balances or winnings. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You must immediately notify bygame of any unauthorized use of your account or any other security breach.

2.3 Account Verification and Know Your Customer (KYC)

In compliance with anti-money laundering (AML) regulations, counter-terrorism financing (CTF) obligations, and PAGCOR licensing requirements, bygame implements comprehensive Know Your Customer (KYC) procedures. You may be required to submit identification documents, proof of address, payment method verification, or other documentation as reasonably requested by bygame. We reserve the right to suspend account functionality, including deposits, gaming, and withdrawals, until satisfactory verification has been completed.

Verification requests must be fulfilled within thirty (30) calendar days of the request being made. Failure to provide requested documentation within this timeframe may result in account suspension or closure. bygame will handle all submitted documents in accordance with our Privacy Policy and applicable Philippine data protection regulations.

3. Deposits, Withdrawals, and Financial Transactions

3.1 Account Funding and Deposits

You may fund your bygame account using any of the approved payment methods displayed on the Platform, including but not limited to GCash, PayMaya, bank transfers via major Philippine banks (BPI, BDO, UnionBank, Metrobank), cryptocurrency (USDT), and over-the-counter cash deposit services. All deposits are subject to minimum and maximum transaction limits as specified for each payment method. bygame does not charge fees for deposits; however, your payment provider may impose its own charges.

Deposits are generally credited to your account instantly or within the timeframe specified for the chosen payment method. bygame is not responsible for delays caused by third-party payment processors or banking institutions. All deposits are made in Philippine Pesos (PHP) or cryptocurrency equivalents, and you are responsible for any currency conversion fees if applicable.

You represent and warrant that all funds deposited to your bygame account are lawfully yours, derived from legitimate sources, and not proceeds of criminal activity. bygame reserves the right to refuse or reverse any deposit that we reasonably believe to be fraudulent, suspicious, or in violation of applicable AML/CTF regulations.

3.2 Withdrawals and Payout Processing

You may request withdrawal of your available account balance (consisting of deposited funds and legitimate winnings, less any pending wagers or bonus restrictions) at any time using approved withdrawal methods. Withdrawals are subject to verification of your identity and account standing, and may be delayed or declined if KYC procedures have not been satisfactorily completed or if there are reasonable grounds to suspect fraudulent activity, bonus abuse, or breach of these Terms.

bygame processes most withdrawal requests within thirty (30) minutes to twenty-four (24) hours for GCash and PayMaya withdrawals during business hours. Bank transfer withdrawals typically complete within one (1) to three (3) business days depending on the receiving bank. Cryptocurrency withdrawals are generally processed within two (2) hours subject to blockchain confirmation times.

Withdrawal requests may be subject to additional security checks, particularly for large amounts or first-time withdrawals. bygame reserves the right to request additional verification documents before processing withdrawals. Minimum and maximum withdrawal limits apply as specified on the Platform for each payment method.

3.3 Inactive Account Policy

An account is considered "Inactive" if you have not logged into the Platform or placed any wagers for a continuous period of twelve (12) months. bygame reserves the right to charge an administrative fee of PHP 200 per month (or the full remaining balance, whichever is less) on Inactive Accounts to cover maintenance costs. You will receive notice via email before any such fees are applied, and you may reactivate your account by logging in and resuming gaming activity.

4. Gaming Rules and Conduct

4.1 General Gaming Provisions

All gaming on the bygame Platform is governed by the specific rules applicable to each game, which are accessible through the game information or help sections. You are responsible for familiarizing yourself with the rules of any game before placing wagers. In the event of any discrepancy between game rules displayed on the Platform and these Terms, the specific game rules shall prevail for matters pertaining to gameplay, payouts, and game-specific conditions.

All games on the bygame Platform use certified Random Number Generators (RNG) or live equipment (for live dealer games) to ensure fair and random outcomes. bygame does not and cannot influence, predict, or manipulate game results. Reported Return to Player (RTP) percentages are theoretical long-term averages and do not guarantee specific results in any individual gaming session.

4.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using automated software, bots, scripts, or any other mechanical or electronic assistance to place bets or play games.
• Colluding with other players to gain an unfair advantage or engaging in chip dumping, bonus abuse, or other fraudulent activities.
• Exploiting errors, bugs, or glitches in the Platform software for financial gain.
• Using VPN, proxy servers, or other means to disguise your location or circumvent geographic restrictions.
• Engaging in money laundering, terrorism financing, or other illegal financial activities through the Platform.
• Providing false information, using stolen payment methods, or attempting to charge back legitimate transactions.
• Harassing, threatening, or abusing other players, customer support staff, or live dealers.
• Attempting to reverse engineer, decompile, or hack any aspect of the Platform.

Violation of these prohibitions will result in immediate account suspension or termination, forfeiture of account balances and winnings, and potential referral to law enforcement authorities where criminal activity is suspected.

4.3 Sports Betting Specific Terms

For sports betting services, all bets are governed by the official results and statistics as determined by the relevant sports governing bodies. bygame reserves the right to void bets in cases of obvious errors in odds, suspected match-fixing, or other circumstances where the integrity of the event is compromised. Maximum payout limits apply to all sports bets and are specified in the sportsbook terms. bygame is not responsible for suspended, postponed, or cancelled events, and specific rules regarding such circumstances are detailed in our sports betting rules.

5. Bonuses and Promotions

5.1 Bonus Terms

bygame offers various bonuses, promotions, and loyalty rewards from time to time ("Promotions"). All Promotions are subject to specific terms and conditions, including wagering requirements, eligible games, maximum bet limits, time restrictions, and expiration dates. These Promotion-specific terms are available on the relevant Promotion page and form part of these Terms.

Unless otherwise stated, all Promotions are limited to one per household, IP address, device, and payment method. Bonus abuse, including but not limited to creating multiple accounts to claim Promotions multiple times, will result in forfeiture of bonuses and associated winnings, and may lead to account closure. bygame reserves the right to withhold, revoke, or cancel any Promotion at its sole discretion without prior notice.

5.2 Wagering Requirements

Bonus funds and winnings derived from bonus play are subject to wagering requirements before they can be withdrawn. The specific wagering requirement (typically expressed as a multiple of the bonus amount, such as "30x wagering") is stated in the applicable Promotion terms. You must fulfill all wagering requirements within the specified timeframe (typically thirty (30) days from bonus activation) or the bonus and associated winnings will expire and be removed from your account.

Not all games contribute equally toward wagering requirements. Contribution percentages are specified in Promotion terms and generally range from 0% to 100% depending on the game type. Placing irregular betting patterns or using low-risk betting strategies solely to meet wagering requirements may be considered bonus abuse and result in forfeiture of bonuses and winnings.

6. Dispute Resolution and Liability

6.1 Complaints and Disputes

If you have a complaint or dispute regarding any aspect of the bygame Platform, you must first contact our customer support team via live chat or email at [email protected] within fourteen (14) calendar days of the event or transaction giving rise to the complaint. Our support team will investigate and attempt to resolve the matter within a reasonable timeframe, typically within seven (7) business days for straightforward matters.

If the dispute cannot be resolved through customer support, you may escalate the matter to our Compliance Department by emailing [email protected] with full details of the dispute, supporting documentation, and your account information. The Compliance Department will conduct a thorough review and provide a final decision within thirty (30) calendar days. bygame's decision in all disputes is final and binding, subject only to applicable PAGCOR dispute resolution procedures.

6.2 Limitation of Liability

To the fullest extent permitted by Philippine law, bygame, its parent company, subsidiaries, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses, even if bygame has been advised of the possibility of such damages.

bygame's total aggregate liability to you for all claims arising from or related to these Terms or your use of the Platform shall not exceed the total amount of deposits you made to your account during the twelve (12) months immediately preceding the event giving rise to liability, or PHP 50,000, whichever is less.

6.3 Force Majeure

bygame shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, telecommunications failures, power outages, cyber attacks, or failures of third-party service providers. In such circumstances, bygame's obligations shall be suspended for the duration of the force majeure event.

7. Account Suspension and Termination

7.1 Suspension by bygame

bygame reserves the right to suspend or temporarily restrict your account at any time, with or without notice, if we reasonably believe that you have breached these Terms, engaged in fraudulent or illegal activity, or if we are required to do so by applicable law, regulation, or law enforcement request. During suspension, you will not be able to access your account, place wagers, or request withdrawals pending investigation and resolution of the matter.

7.2 Termination by bygame

bygame may terminate your account and these Terms immediately, without prior notice, if you materially breach these Terms, provide false information, engage in prohibited activities, or if we determine in our sole discretion that continued provision of services to you poses unacceptable risk to bygame or other players. Upon termination, you must immediately cease all use of the Platform. Any remaining account balance will be returned to you via your registered withdrawal method, less any amounts owed to bygame, after deducting any applicable fees or charges and subject to completion of all necessary verification and investigation.

7.3 Termination by You

You may close your account at any time by contacting customer support or using the account closure option in your account settings. If you wish to self-exclude for responsible gaming reasons, please refer to our Responsible Gaming Policy for permanent self-exclusion procedures. Upon account closure, you must withdraw any remaining balance before the closure becomes effective. bygame is not responsible for any balance remaining in a closed account.

8. Intellectual Property and License

All content on the bygame Platform, including but not limited to text, graphics, logos, images, software, audio, video, game content, and compilation thereof, is the exclusive property of bygame or its licensors and is protected by Philippine and international intellectual property laws. The bygame name, logo, and all related trademarks, service marks, and trade dress are proprietary to bygame.

bygame grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial entertainment purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Platform except as incidentally necessary for normal web browsing or as expressly permitted in writing by bygame.

Any unauthorized use of the Platform or its content may violate copyright, trademark, patent, and other intellectual property laws, and may subject you to civil and criminal liability. You agree not to frame, deep-link, or otherwise incorporate any portion of the Platform into any other website or service without bygame's prior written consent.

9. Governing Law and Jurisdiction

These Terms and any disputes arising from or relating to the Platform or your use thereof shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Metro Manila, Philippines, for resolution of any disputes arising from these Terms or your use of the Platform.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The failure of bygame to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
